  • Case Dismissed June 2025 Case Result – Brockton District Court

    In June 2025, Attorney James G. DeGiacomo represented a client in the Brockton District Court on a Motion to Seal. In this motion, the client was attempting to have a prior assault and battery case sealed so that it would not affect her employment opportunities in the future. At the hearing, Attorney DeGiacomo was able to show that the case that had been previously dismissed was more of a misunderstanding than a criminal situation, and that the client had a bright future ahead of her in the education field. The judge agreed and sealed the case.

  • Case Dismissed June 2025 Case Result – Hingham District Court

    In June 2025, Attorney James G. DeGiacomo represented a client in the Hingham District Court on charges of Assault and Battery with a Dangerous Weapon, Assault and Battery on a Family Household Member, and Threat to Commit a Crime after a domestic incent with the client’s girlfriend. After reviewing the case, Attorney DeGiacomo believed that it was going to be unlikely that the alleged victim would participate in the client’s prosecution. In addition, Attorney DeGiacomo was able to obtain evidence that the alleged victim had fabricated prior charges against the client. With this in mind, Attorney DeGiacomo was able to secure a trial date within 30 days of his client’s arrest. At the trial date, the judge dismissed the case due to non-cooperation of the alleged victim.

    In June 2025, Attorney James G. DeGiacomo represented a client in the Brockton District Court on charges of Leaving the Scene of Property Damage after was alleged that the client had hit a parked bus and left the scene of the accident. At the Clerk Magistrate’s Hearing, Attorney DeGiacomo was able to put the incident into the proper context and convince the clerk not to issue the criminal charges.

    In June 2025, Attorney James G. DeGiacomo represented a client in the Malden District Court on charges of Assault and Battery on a Family Household Member after it was alleged that the client had been in a physical altercation with his wife. Knowing from the start of the case that the wife wasn’t going to willingly participate with the prosecution, Attorney DeGiacomo immediacy scheduled the case for trial. At the trial date, the wife failed to appear to court and the case was dismissed.

  • Case Dismissed May 2025 Case Result – Stoughton District Court

    In May 2025, Attorney James G. DeGiacomo represented a client in the Stoughton District Court on charges of Assault and Battery on a Family Household Member after it was alleged that the client had broken his girlfriend’s finger during an argument. Shortly after being retained, the client reached out to Attorney DeGiacomo to inform him that he had gotten back together with his ex. Having practiced in the criminal court system for over a decade, Attorney DeGiacomo knew that in these situations it was unlikely that the alleged victim was going to be willing to testify. As such, he quickly scheduled the case for trial and secured a dismissal of all charges.

  • Not Guilty May 2025 Case Result – Taunton District Court

    In May 2025, Attorney James G. DeGiacomo represented a client in the Taunton District Court on charges of Indecent Assault and Battery after he was accused of forcibly raping his neighbor. The May 2025 trial was the second trial for this case as the prior trial in January 2025 resulted in a mistrial due to juror misconduct during deliberations. Due to the prior mistrial, Attorney DeGiacomo was able to get transcripts of the prior testimony of the witnesses. This proved helpful when the witnesses, who already had significant inconsistences with their testimony, told a completely new story about what happened during the May 2025 trial. Armed with their prior testimony, Attorney DeGiacomo was able to get one of the witnesses to admit to changing her story on the stand. The jury needed less than an hour to find the client NOT GUILTY.

  • Case Dismissed May 2025 Case Result – Brockton District Court

    In May 2025, Attorney James G. DeGiacomo represented a client in the Brockton District Court on several forgery related charges after the client was accused of forging and cashing a check. After reviewing a significant amount of discovery, it became clear to Attorney DeGiacomo that the police who investigated the case believed they had an iron-clad case. However, it was also clear that the police had no idea what was needed for the prosecutor to actually prove the case at trial, as they had no way to show that the client was in fact the person who entered the bank. Due to this, Attorney DeGiacomo scheduled the case for trial and moved to dismiss the case. The judge agreed with Attorney DeGiacomo and dismissed all charges.

  • Case Dismissed May 2025 Case Result – Brockton District Court

    In May 2025, Attorney James G. DeGiacomo represented a client in the Brockton District Court on a charge of Assault and Battery with a Dangerous Weapon after the client was accused of striking someone with their car during a road rage incident. Upon being retained, Attorney DeGiacomo determined that the prosecutor would be unable to have his client properly identified during the trial due to a faulty police investigation. With this information, Attorney DeGiacomo quickly scheduled the case for trial and secured the dismissal for his client.

  • Case Dismissed March 2025 Case Result – Salem District Court

    In March 2025, Attorney James G. DeGiacomo represented a client in the Salem District Court on a charge of OUI Drugs after it was alleged that the client had been in a car accident and was exhibiting signs of impairment from drugs. Upon review of the case, Attorney DeGiacomo immediately recognized that even though the allegations made it clear that the client was under the influence, the police were not able to present any evidence to suggest what drug the client had taken. Because the case law is clear that the drug in question must be known and stated in the police report, Attorney DeGiacomo argued and won a motion to dismiss. This ensured that the client would not lose his driver’s license and wouldn’t face any criminal penalties.
