DeGiacomo and and Sergey Mikhlin with OUI or DUI cases is: “what is a CWOF?” CWOF stands for “Continuance Without A Finding,” and it is a type of disposition that can be given for many difference charges if the defendant decides to plead instead of taking the case to trial. A CWOF is only available to people charged with a First Offense OUI or people charged with a Second Offense OUI when their first offense was over ten years ago.

The benefit of a CWOF is that at the end of the probation term, the case is dismissed, meaning that if you didn’t have any convictions on your criminal record prior to your OUI, you still won’t have any afterwards. However, there are downsides as well. One of those is that your insurance company will still consider it a conviction and raise your rates. You also aren’t able to avoid any addition license suspensions.
